Jeffery M. Leving Leads the Fight for Justice for Illinois Fathers This is the letter Jeffery M. Leving sent to Illinois Legislators on behalf of Illinois fathers. Please use the link below to contact your legislators and let them know your feelings about the unfair treatment of fathers based upon the current statute requiring child support obligors to pay 9% interest. November 16, 2009 Representative Paul D. Froehlich Dear Representative Froehlich, As the nation’s economic crisis continues, I know of no investment vehicle that pays anything approaching 9% interest. Yet, statutory interest on child support arrearages as a series of judgments continues to accrue at this incredibly high rate. We see indigent fathers come into our office daily, despondent and hopeless because their child support arrearages are accruing interest far beyond their ability to ever pay. These arrears are often accrued when obligors lose their employment or are incarcerated and fail to file petitions to reduce or suspend support. Child support arrears are therefore imputed for income these men have never even received. When these fathers become re-employed, State agencies, aside from garnishing their wages for current and back support, are vigorously seizing any bank accounts they may establish and intercepting any income tax refunds they receive. It is time for the State of Illinois to end this injustice, give family law judges discretion to waive interest accruals, which formerly was the law, and to lower interest rates on future delinquencies to a percentage that reflects the current economy. This relief will assist the poor and indigent in retiring their debts, encourage their return to involvement with their children, and further relieve them from a sense of hopelessness and victimization.
